General terms

Audits
Customers may upon request, after reasonable notice, inspect Eurofins MikroKemi's (called MikroKemi) facilities, quality system as well as analytical documentation (including raw data) relevant to the customer's samples. Such an audit is to be performed during normal business hours or at another time agreed upon in advance. Audits are granted on the same terms to third parties inspectiing the customer. Examples of such third parties are MPA and FDA.

Delivery time
Delivery time is dependent on the type of analysis and if any special agreement is in existence. Most analyses are carried out and an analysis report is sent within 10-12 working days after receipt of sample. Delivery times for elemental and water analysis is generally shorter. Express service is available at surcharge.

Liability
MikroKemi is responsible, with the limitations described below, for damages caused by Mikro Kemi's error or neglect affecting the customer.

The liability to damages extends only to compensation for direct expenses caused by error or neglect. It does not cover indirect damage (indirect loss) such as unrealized profit, expected savings, loss of income or other general property damage. MikroKemi’s liability does not cover damages caused by the customer, e.g. by incorrectly reporting relevant facts or information, or by making changes in results supplied by MikroKemi without approval by MikroKemi. MikroKemi’s total liability resulting from the assignment is limited to one Swedish basic amount.

The limitations in MikroKemi’s liability are not applicable in connection with personal injury or damage resulting from gross negligence on the part of MikroKemi. The responsibility shall then be legally judged. The right to damages according to the above is forfeited if a claim for damages is not promptly made in written form, within six months after the date the customer obtained the analysis results at the latest.

Raw data
Raw data (originals) are archived at MikroKemi for 10 years unless otherwise is agreed in writing. After 10 years destruction of raw data is done under controlled forms.

Return of samples
Unless otherwise agreed, samples are saved for three weeks after the analytical report is sent. After three weeks the remaining samples are destroyed. Remaining samples can be sent back upon request and the customer will be charged return shipping.

Safety information
The customer is responsible for providing MikroKemi with all relevant information about the substance to be analyzed. It is imperative that carcinogenic, corrosive, poisonous or in other way dangerous substances are marked clearly and correctly. An MSDS (material safety data sheet) describing risks and safety measures shall be enclosed with the substance or made available to MikroKemi before the substance arrives.

Terms of payment
Our standard payment term is 20 days net. In case of payment after the maturity date, interest on overdue payment is charged corresponding to the Swedish central bank's official discount rate + 8 %. MikroKemi reserves the right to credit check before granting any credit.
